Privacy Policy

This Privacy Policy describes how Fanfluencer, LLC ("Fanfluencer", "we") collects, uses, shares, and protects information about you when you use the Fanfluencer platform, websites, and services (the "Service").
1. Information You Provide to Us.
When you create an account or use the Service, we collect:
(a) Identification — name, email address, password (stored as a one-way bcrypt hash), and account role (musician, creator, agency, admin).
(b) Profile — stage name or creator handle, bio, genre, profile photo, optional links to your distribution channels (Spotify, Apple Music, SoundCloud).
(c) Songs (artists only) — song titles, ISRC codes, TikTok and Instagram sound URLs and IDs, optional artwork, and rights-attestation timestamps.
(d) Campaigns and applications — campaign briefs, targeting parameters, creator applications and pitches.
(e) Posts and analytics (creators only) — URLs to your TikTok / Instagram / YouTube posts that participate in campaigns, and the post's view, like, comment, and share counts as reported by audience-verification services.
(f) Payment information — handled directly by Stripe. We store only your Stripe customer ID; we do not store card numbers, CVVs, or bank account details.
2. Information Collected Automatically.
We collect basic technical information about how you use the Service:
(a) Server logs — IP address, browser type, referring URL, pages visited, timestamps. Used for security and to debug operational issues.
(b) Session cookies — required to keep you logged in. We do not use third-party advertising or cross-site tracking cookies.
(c) Email engagement — whether you opened or clicked links in transactional emails we send.
3. Information from Third-Party Services.
With your authorization, we collect information from third-party services to operate the Service:
(a) Social platform analytics (audience verification). When creators link an Instagram, TikTok, or YouTube account, we read public follower counts and post metadata via authorized analytics partners to verify campaign eligibility and audit posts.
(b) Spotify (artist accounts only, optional). If you connect your Spotify for Artists account, we read your artist profile, verified-artist status, and track catalog metadata.
(c) Stripe (payments). We receive transaction status, last-four card digits, and refund / chargeback events from Stripe.
4. How We Use Information.
We use the information described above to:
(a) Run the marketplace — display campaigns, route applications, accept creators, dispatch payouts.
(b) Verify eligibility — confirm creators meet a campaign's follower minimum and that artists own or are authorized for the songs they register.
(c) Process payments — charge artist accounts and pay creators via Stripe and Stripe Connect.
(d) Send transactional emails — account confirmations, password resets, application updates, payout notifications.
(e) Detect and prevent fraud, abuse, and violations of our Terms of Service.
(f) Improve and develop the Service — identify bugs, prioritize features, audit performance.
5. How We Share Information.
We do not sell your personal information. We share information only as follows:
(a) Between marketplace participants. When a creator applies to a campaign, the artist sees the creator's handle, follower count, and pitch. When the artist accepts, the creator sees the artist's name and campaign details. Email addresses are never shared between artists and creators directly.
(b) Service providers (sub-processors): Stripe (payments and creator payouts), audience-verification partners (Apify, Phyllo), Spotify (optional artist OAuth), Resend (transactional email), Vercel and / or Neon (hosting and database), AWS / Vercel Blob (file storage). Each has their own privacy policy.
(c) Legal requirements. We may disclose information in response to valid legal process (subpoenas, court orders) or where required to comply with law.
(d) Business transfers. If Fanfluencer is acquired or merged with another company, your information may transfer to the successor entity, subject to this Privacy Policy.
6. Data Retention.
We retain your information for as long as your account is active, or as needed to provide the Service. After account closure, we retain transactional records (campaigns, payouts, signed agreements) for the period required by applicable tax, accounting, and dispute-resolution law (typically 7 years in the United States). Other personal information is deleted within 90 days of account closure.
7. Your Rights.
You have the right to:
(a) Access and export your personal information.
(b) Correct inaccurate information from your account settings.
(c) Delete your account and personal information (subject to the retention exceptions in §6).
(d) Withdraw consent for optional integrations (Spotify, audience verification) at any time.
(e) Opt out of non-essential email communications.
To exercise these rights, email hello@fanfluencer.io with the subject "Privacy request." We respond to all verified requests within 30 days.
If you are a resident of the European Economic Area, the United Kingdom, or California, you may have additional rights under GDPR, UK GDPR, or the California Consumer Privacy Act (CCPA). These rights are honored equivalently for all users.
8. Children.
The Service is not directed to children under 18. We do not knowingly collect information from anyone under 18. If we learn we have collected information from a person under 18, we will delete it promptly.
9. International Data Transfers.
The Service is operated from the United States. If you use the Service from outside the U.S., your information will be transferred to and processed in the U.S., where data protection laws may differ from those in your jurisdiction.
10. Security.
We use industry-standard practices to protect your information: TLS encryption in transit, encrypted backups at rest, bcrypt password hashing, principle-of-least-privilege access controls. No system is perfectly secure, however, and we cannot guarantee absolute protection. Promptly notify us if you believe your account has been compromised.
11. Changes to This Policy.
We may update this Privacy Policy from time to time. Material changes will be communicated by email and / or in-app notice. The "Last updated" date at the top reflects the current version.
